Drone Harmony – Privacy Policy

In this Privacy Policy, we describe how we, Drone Harmony AG, Sonnentalstrasse 8, 8600 Dübendorf, Switzerland (“DH”, “we” or “us”), process your personal data if:

(a) you visit our website (the “Website”) (“Website Visitors”);
(b) you use the Drone Harmony software or other services we offer (the “Services”) (“Users”).
(c) you apply for a job with us (“Job Applicants”);
(d) we receive your personal data for other purposes related to our business activities.

We process your personal data:

(a) either as a data controller, which means that we are directly responsible for your personal data;
(b) or as a data processor while performing a contract with the company or other institution you work/provide services for. In this case, the company or other institution is primarily responsible for your personal data.

1. Personal Data We Process

1.1 Users

What you give usTo use the Services, you will need a DH account (the “Account”). When you sign up for the Account, we will ask for personal data, like your name, email address, payment information, etc. Once you are signed up, by your choice, you can add more personal data to your profile by editing it. In addition, we will process data resulting from your use of the Services, and data you choose to synchronize or otherwise upload (including images, videos, flight plans, flight scene environments, flight logs, and flight metadata). If you choose to synchronize your data, DH will enable the sharing and synchronizing of your data across your devices. Note that we also store communications that you send to us, such as your emails, your support requests, feedback, and ideas. We do not ask you to provide sensitive data, and we do not collect such data on purpose.
From third partiesWe allow you to sign up and log in to the Services using an existing third-party account (e.g., Google, Apple). If you register through such an account, we will process the data that you have agreed to make available, like your account ID, name, profile picture, and email. This data is collected by the third-party account provider (i.e., Google, Apple) and is provided to us under their own privacy policies. You can generally control the data we receive from these sources using the privacy settings in your third-party account.
If you use our Services in conjunction with software by one of our partners (e.g., FlyNex), your DH Account will be connected to your account with our partner, and we will process your data originating from that account. This data is collected by the respective partner and is provided to us under its own privacy policies.
From your useWe track your behavior throughout your use of the Website, the App and the Web Platform. Specifically, we may track the features and Services you use and how you use them (including your browser type, type of computer or mobile device, language, IP address, mobile carrier, unique device identifier, location, requested and referring URLs, as well as the kinds of flights you perform and the kinds of drones you use) and may store and/or process any such information.

We may use various technologies to collect and store information when you use the Website, the App or the Web Platform. This may include using cookies or related technologies (hereafter “Cookies ”). Cookies are small files that a site or its service provider transfers to your computer/device’s hard drive that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. It may be possible to disable some Cookies through your device or browser settings, but doing so may affect the functionality of the Services. The method for disabling Cookies may vary by device and browser but can usually be found in preferences or security settings.

1.2 Users and Website Visitors

What you give usIf you contact us through the Website (e.g. through the contact form or when signing up for our newsletter), we collect your contact and other relevant personal data you provide us with.
From your useWe log certain technical data and track your use of the Website and the Services. Specifically, we track the features and Services you use and how you use them (including your browser type, type of computer or mobile device, language, IP address, mobile carrier, unique device identifier, location, requested and referring URLs, as well as the kinds of flights you perform and the kinds of drones you use).

1.3 Job Applicants

What you give usWhen you apply for a job with us, we collect and process the personal data you provide us with in the application process. This includes, in particular, contact data like your name, email, address, etc., other data from your application documents, and our communications.
From your useWe log certain technical data and track your use of the Website and the Services. Specifically, we track the features and Services you use and how you use them (including your browser type, type of computer or mobile device, language, IP address, mobile carrier, unique device identifier, location, requested and referring URLs, as well as the kinds of flights you perform and the kinds of drones you use).
We may also collect and process personal data from other sources (e.g. from social networks or the internet) to review your application and carry out the application process. If you provide us with references to contact, we will also obtain data from them.

If your application is successful, we will use the personal data collected during the application process and any data you provide us with after the application process to prepare and conclude our contract with you.

1.4 Other

In the course of our business activities, we process personal data from other persons, such as our contacts at potential customers, customers, business partners, suppliers and service providers. In general, the personal data processed is primarily contact data and communication content, as well as other personal data required in this context.

2. How We Use Your Personal Data

We process your personal data for the following purposes and based on the following grounds for processing:

(a) to enter into, fulfill, and enforce a contract; in particular, for Users, the contract on the use of our Services:
(i) with you, if we act as data controllers, or
(ii) with the company or other institution you work/provide services for if we act as a data processor;
(b) based on your consent, if applicable;
(c) based on our legitimate interests to communicate with you or third parties (including for reasons other than for the preparation or conclusion of a contract), to optimize your user experience, to improve the Website and the Services, to develop new services and functionalities to better serve you, to analyze demand patterns or conduct other evaluations, to ensure IT security and data protection, to guarantee business operations and the management and development of our company, and to enforce or defend legal claims;
(d) to comply with legal obligations (e.g., an obligation to keep business records).


In accordance with our dedication to keeping individuals who express interest in our products or services apprised of our current offerings and any new developments, we may, from time to time, transmit marketing materials (e.g., newsletters) to you. You can opt out of receiving such information at any time. However, as a User, you do not have the option to stop receiving administrative or service-related emails and notifications as they are necessary to provide the Services you requested.

3. Third-Party Transfers

We may transfer your personal data to third parties to fulfill a contract, to comply with legal requirements, or based on our legitimate interests.

This includes, in particular:

(a) third parties that provide services for us, such as communications and hosting services, network security, technical and customer support, tracking and reporting functions, quality assurance testing, payment processing, our own marketing of the Services, and other functions.
(b) our partners (e.g. FlyNex), if you use our Services in conjunction with their software. Your DH Account will be connected to and exchange data with the account you have with our partner.
(c) cases where a transfer is necessary to (i) comply with a legal obligation, (ii) ensure IT security and data protection, or (iii) enforce, defend or avert legal claims.
(d) If we are acquired by or merge with another company, or in similar situations, we may transfer your personal data to the other company.

We do not sell or rent your personal data to third parties.

4. International Data Transfers

Our software and database is located on servers in the EU. This is where we store your personal data in connection with your use of the Services.
Other personal data may be transferred outside Switzerland and the European Economic Area (EEA). If the recipient country in question does not have a level of data protection recognized by Switzerland or the EU respectively, we will take care that safeguards are in place to ensure adequate protection for your personal data, e.g. by concluding standard contractual clauses, where necessary and possible supplemented with additional security measures.

5. Data Security

We follow generally accepted industry standards to protect personal data submitted to us, both during transmission and after receiving it.
However, no method of transmission over the internet or via a mobile device or method of electronic storage is fully secure. Therefore, while we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

6. Data Retention

We store your personal data only for as long as and to the extent necessary for the purposes described or for legal reasons.

For Users, if you close your Account, we will continue to retain your data as a backup for a period of 12 (twelve) months. Thereafter, we will permanently delete your data from our systems unless continued retention is required for the purposes described above or for legal reasons.

Note that we will not delete your data if your Account is not canceled but only deactivated due to non-payment of the subscription fees. Please contact us at contact@droneharmony.com if you wish to cancel an Account that has been deactivated.

In some circumstances, we may anonymize your personal data for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

7. Your Legal Rights

If provided for and subject to the conditions of the applicable data protection laws, you have the following rights in connection with your personal data:
(a) right to access your personal data;
(b) right to have inaccurate personal data rectified;
(c) right to erasure (“right to be forgotten”);
(d) right to restrict the processing of your personal data;
(e) right to data portability;
(f) right to object to the processing of your personal data.

Please note that exceptions apply to these rights. In particular, we may be obliged or entitled to further process your personal data to fulfill a contract, to protect our own legitimate interests, such as the assertion, exercise, or defense of legal claims, or to comply with legal obligations. In these cases, we can or must reject certain requests or comply with them only to a limited extent.

We may request specific information from you to help us confirm your identity and ensure your right to access your personal data or to exercise any of your other rights. We may also contact you to ask you for further information to respond to your inquiry more quickly. We usually do not charge any fees if you request to access your personal data, but we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. We try to respond to all legitimate requests within one month.

If we act as a data processor, we will forward your request to the relevant data controller.

8. Complaints

Please contact us first at contact@droneharmony.com if you have a complaint or concern about how we process your personal data, so we can try to solve it for you.

You also have the right to lodge a complaint with the competent supervisory authority for data protection issues. The Federal Data Protection and Information Commissioner (EDÖB) is the relevant supervisory authority in Switzerland.

9. Third-Party Products and Services

We may include or offer third-party products or services with our Website or the Services. These third parties may have separate and independent privacy policies and practices that are beyond our control. We encourage you to review the privacy practices of such third parties. We make no guarantees about and assume no responsibility for the activities, services, or data/privacy practices of these third parties. 10. Protection of Children

The Website and the Services are not intended for minors and particularly not directed to children under 13. We do not knowingly collect personal data from children. If we become aware that a child has provided us with personal data without parental consent, we will delete such data from our systems.
